This Privacy Policy is effective from Dec 15, 2022

REVEAL SOUND PTY LTD (hereinafter - "we", "our", "us", "Reveal Sound") is a company specializing in creating and distribution of various sounds samples and presets, developing and distribution of software synthesizers by selling licences.

We, at Reveal Sound, have created a Privacy Policy that aims to help you understand what data we collect, what we use it for and how you can exercise your rights. Reading Privacy Policy is important, so we hope you will give it time and attention.

Privacy and security of our customers and visitors are of paramount importance for us. We are committed to protecting the data you share with us. This Privacy Policy explains how we process information that can be used to directly or indirectly identify individuals ("Personal Data") collected through the use of our website.

For the purposes of this Policy, we define the term "Customer" as a person who has created his or her own account on the Reveal Sound website (www.reveal-sound.com) or used our Serial Activation Code at https://reveal-sound.com/activation.html to activate the personal license, and the term "Visitor" as an individual who visits our website.

In order to carry out our obligations under contracts between us and content authors we have to process the information (including Personal Data) they give us.

We adhere to the following principles in order to protect your privacy:

● principle of purposefulness - we process Personal Data fairly and in a transparent manner only, aiming to achieve determined and lawful objectives, and they shall not be processed in a manner not conforming to the objectives of data processing;

● principle of minimalism - we collect Personal Data only to the extent necessary to achieve determined purposes. We do not keep Personal Data if it is no longer needed;

● principle of restricted use - we use Personal Data for all other purposes only with the consent of the data subject or if permitted by a competent authority;

● principle of data quality - we always keep Personal Data up-to-date and complete in order to achieve the end purpose of the data processing more efficiently;

● principle of security - security measures shall be applied in order to protect Personal Data from unauthorised or unlawful processing and against accidental loss, destruction or damage, using appropriate technical and organisational measures;

● principle of individual participation - our Customers and Visitors shall be notified of data collected in connection to them. They shall be granted access to their Personal Data and have the right to demand a correction of inaccurate or misleading data.

1. Data we collect and purposes of data processing


1.1. Websites Visitors

1.1.1. We may collect, record and analyze information of Visitors to our website. Cookies and widgets are used by us and our partners (Google, Yandex, Facebook). We use Google Analytics and Yandex Metrika to analyze data and Google Adwords for advertising. Information collected this way is stored for no longer that one year.

1.1.2. We record information, such as your geographical location, Internet service provider and IP address. We also record information about the software you use to browse our website, as well as the type of computer or device you use and the screen resolution you have on it. We collect data through visits to our website, including count of Visitors and visits, length of time spent on the website, pages clicked on and where Visitors have come from. Requests by your web browser to our servers for web pages and other content on our website are recorded.

1.1.3. We use this information in aggregate to assess the popularity of the web pages on our website and how we perform in providing content to you. When combined with other information, we know about you from previous visits, the data possibly could be used to identify you personally, even if you are not signed into our website.

1.1.4. When you contact us, whether by telephone or email, you give us your implicit consent because you reasonably expect us to reply. We collect the data you give us in order to reply with the information you need. We record your request and our reply in order to increase the efficiency of our organisation. We keep personally identifiable information associated with your message, such as your name and email address, so as to be able to track our communications with you in order to provide you with high quality service.

1.1.5. We may process information only if there is a legitimate interest. We do so after having given careful consideration to:

● whether the same objective could be achieved through other means;

● whether you would expect us to process your data and consider it reasonable for us to do so.

● To create anonymous, aggregated statistics about the use of our website, products, services and other programmes, which we may share with third parties and/or make available to the public.
● To develop and improve new and existing Reveal Sound products and services, recommendations, advertisements and other communications, and learn more about our users’ music and sound preferences in general.

1.1.6. Wherever possible, we aim to obtain your explicit consent to process this information, for example, by asking you to agree to our use of cookies.

1.2. Customers

1.2.1. In order to provide services to our Customers, we collect their personally identifiable information.

1.2.2. When you create an account on our website, buy a product or service from us, a contract is formed between you and us. In order to carry out our obligations under that contract we must process the information you give us.

1.2.3. During the creation of your account on our website, you provide us with your email address. After the confirmation of your email, in your profile, you may enter your name and billing address (street, zip/postal code, city, state, country). This information is used by us to identify our Customers and provide you with services, billing, issue of licences, mailings, notification, support, marketing actions, ability to see purchases and restore them in case of loss and to meet other obligations. Also we may use it in order to provide you with suggestions and advice on products, services and how to obtain the most from using our website. We use such data in ways you would reasonably expect and which have a minimal privacy impact.

1.2.4. We may obtain your Personal Data from third parties. We receive such data when you purchase your products at third party marketplaces, whose services we use.

1.2.5. We process this information on the basis there is a contract between us, or that you have requested we use the information before we enter into a legal contract.

1.2.6. Payment information is never taken by us or transferred to us either through our website or otherwise. Our employees and contractors never have access to it. At the point of payment, you are transferred to a secure page on the website of ShareIt or 2checkout payment service provider. That page may be branded to look like a page on our website, but it is not controlled by us.

1.2.7. Processing of Personal Data for marketing purposes is also relied on the consent obtained from you. We use data in ways you would reasonably expect and which have a minimal privacy impact.

2. Cookies


2.1. Cookies are small text files that are placed on your computer's hard drive by your web browser when you visit any website. 3. Сompliance with General Data Protection Regulation (GDPR)


3.1. For Visitors, Customers and Customer’s Clients located in the European Economic Area (EEA) privacy rights are granted and all processing of Personal Data is performed in accordance with regulations and rules of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of Personal Data and on the free movement of such data, known as the General Data Protection Regulation (GDPR) and the national legislation.

3.2. We process Personal Data as a Controller, as defined in the GDPR:

● Reveal Sound, with which, you as a Customer, have entered into an agreement when you created your account at the Reveal Sound website or have used our Serial Activation Code, will be the Controller of Customer Data, as outlined above in the "Customer" section.
● Also, Reveal Sound will be the Controller for Visitor Data, as outlined above in "Visitor" section.

3.3. Our Privacy Policy is compliant with the laws of every country or legal jurisdiction within which we aim to do business. If you think it fails to satisfy the law of your jurisdiction, we should like to hear from you. However, ultimately it is your choice as to whether you wish to use our website.

4. Information for California Residents


Reveal Sound does not sell consumer personal information for monetary or other valuable consideration.

California Civil Code Section 1798.83, also known as the “Shine The Light” law, permits our users who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year. If you are a California resident and would like to make such a request, please send an email message to [email protected]. with "Request for CCPA" on the subject line. We will provide the requested information at your email address in response. Please note that information sharing which is covered only by the CCPA requirements will be included in our response.

If you are reside in California, and have a registered account on Reveal Sound website, you have the right to know what personal information about them is collected, request deletion of their personal data, opt-out of the sale of their personal data, and not be discriminated against if they choose to exercise any of these rights. To request removal of such data, please send an email message to [email protected]. with "Request for removal (CCPA)" on the subject line.

5. Data access, data correction, data deletion, data portability and withdrawal of the consent


5.1. Visitors and Customers can review, correct, update, delete or transfer their personally identifiable information. For that, contact us directly at [email protected]. We will acknowledge your request within 72 (seventy-two) hours and handle it promptly as required by law. Deletion of your data may limit the service we can provide to you.

5.2. When we receive any request to access, edit or delete personally identifiable information, we shall first take reasonable steps to verify your identity before granting you access or otherwise taking any action. This is important to safeguard your information.

5.3. You can withdraw your consents at any time by contacting us directly at [email protected].

6. Data Retention


6.1. We will retain Personal Data for as long as you, as the Customer, use your account on our website. Any data collected for the purpose of analytics will be deleted within 12 (twelve) months after being collected.

6.2. Any information about the Visitors is deleted on an annual basis. Your information will be deleted if you did not communicate with the support team for more than 12 (twelve) months.

6.3. If you no longer wish to receive promotional emails, you may opt out of them by replying to one of such emails or send us an email with a request to unsubscribe. Please note that you cannot unsubscribe from certain email correspondence from us, such as messages relating to your account transactions, software updates and instructions.

7. Information Security


7.1. We care to ensure the security of Personal Data. We follow generally accepted industry standards to protect the information submitted to us, both during transmission and once we receive it. We maintain technical, physical, and administrative security measures to provide reasonable protection for your Personal Data. When we or our contractors process your information, we also make sure that your information is protected from unauthorized access, loss, manipulation, falsification, destruction or unauthorized disclosure. This is done through appropriate administrative, technical and physical measures.

7.2. We always use pseudonymisation as a method of securing Personal Data we process as the Processor.

7.3. There is no 100% secure method of transmission over the Internet or electronic storage.We therefore cannot guarantee its absolute security.

7.4. We never process any kind of sensitive data and/or criminal offence data, neither as a Controller nor as a Processor. Also, we never undertake profiling of Personal Data.

8. Contractors


8.1. We work with third party service providers which provide website development, hosting, maintenance, sending emails, marketing, technical support and assistance, processing credit card payments, IT and cyber security services, fraud checking services, customer service and other services for us. They may be located outside of the EEA, namely in the Russian Federation and Ukraine. These contractors may have access to, or process Personal Data on behalf of us, as part of providing those services to us. We limit the information provided to these service providers to the extent it is reasonably necessary for them to perform their functions.

8.2. We guarantee that we have Data Processing Agreements in place with our service providers, ensuring compliance with the GDPR and our contracts with them requiring to maintain the confidentiality of such information. All data transfers inside and outside of the EEA are being done in accordance with these Data Processing Agreements. All data transfers are performed in accordance with the strictest security regulations.

8.4. All data processed by us is stored exclusively in secure hosting facilities provided by DreamHost LLC. (https://www.dreamhost.com) and located in the United States of America. DreamHost's infrastructure is secured through a defense-in-depth layered approach.

8.5. Issuance of licences takes place in secure hosting facilities provided by Netherlands B.V. (https://www.leaseweb.com) and located in the Kingdom of the Netherlands.

8.6. For the purpose of sending you our marketing and notifications emails, we use a service provided by the Rocket Science Group LLC d/b/a MailChimp (https://mailchimp.com). This company processes your Personal Data, such as email address and name provided by us.

8.7. We share your Personal Data (name, email and billing address) with payment processing service providers Share-it! (https://secure.shareit.com/shareit/impressum.html) provided by Digital River GmbH and 2checkout (https://www.2checkout.com) provided by 2Checkout.com, Inc only for billing purposes.

9. Use of site by children


9.1. We do not sell products,provide services or market to children.

9.2. If you are under the age of 16, you may use our website only with consent from a parent or guardian.

9.3. We collect data about all Customers and Visitors regardless of age. We do anticipate that some of those users and visitors will be children.

9.4. Underage Customers and Visitors will most likely visit other parts of the site and be subjected to whatever on-site marketing they find, wherever they visit.

10. Application of this Privacy Policy


10.1. This Privacy Policy is applicable to our website and. Our website also contains links to other websites. Once you are redirected to another website, this Policy is no longer applicable. This version of the Privacy Policy is effective as of May 2018.

11. Acceptance of these Conditions


11.1. We assume that all Visitors and Customers have carefully read this document,understand its contents and agree to the terms and conditions stated in the Privacy Police above. If one does not agree with this Privacy Policy, they should refrain from using our website.
